Chief Justice Gary Wade has written a unanimous state Supreme Court ruling that prosecutors can indict a John Doe using DNA evidence, and that the statute of limitations does not run out if the John Doe is identified in later years.
A woman was raped in 1994 and prosecutors took DNA evidence and indicted a John Doe with that DNA match in 2000. Later, Robert Jason Burdick, known as the Wooded Rapist, was convicted. He appealed saying he was not caught until after the statute of limitations ran out.
The court ruled that indicting the John Doe with that DNA profile was sufficient to convict Burdick.
